LAWFUEL – Legal News Network – In a decision featured in Tuesday’s New York Law Journal, Paul, Weiss won a significant victory for pro bono client Restaurant Opportunities Center of New York (ROC-NY) when Justice Edward H. Lehner of the New York Supreme Court granted ROC-NY’s motion to dismiss a complaint brought by the Redeye Grill, an upscale midtown restaurant. The action arose out of two public demonstrations that ROC-NY organized outside the Redeye Grill to protest the restaurant’s mistreatment of its workers. Paul, Weiss also represents, on a pro bono basis, the Redeye Grill workers in a federal action they have brought for violations of federal, state and local labor laws. The complaint against ROC-NY asserted causes of action for unfair competition, injurious falsehood, tortious interference with business relations, deceptive trade practices, prima facie tort, civil conspiracy and injunctive relief. In moving to dismiss, we argued primarily that ROC-NY’s demonstrations were protected by the First Amendment. Justice Lehner agreed with all of our arguments and dismissed the complaint in its entirety. The Paul, Weiss team included litigation partner Chris Boehning; and associates Stacey Shortall, Daniel Kirschbaum (who argued the motion for ROC-NY) and Melissa Chua.
