LawFuel.com – Best Law Firm Newswire Service – A serious accident that left a bicyclist with severe injuries to her face and neck has resulted in a $750,000 settlement according to Daily Report Online in the case of Krehn v. Grant and Miracle House Church, No. SU13CV0381-SW.
The lawsuit was filed after the insurance company for the van driver offered $250,000 at mediation. Atlanta injury attorney, Christopher Simon advised the client to stick to the firm’s internal evaluation of value and during the litigation was able to persuade the insurance company to see the case similarly.
In October of last year, Xaunna Jade Krehn, then a 20-year-old pre-med student at the University of Georgia, collided with a 1995 Ford Club Wagon owned by Miracle House Church International in Athens in case of Krehn v. Grant and Miracle House Church, No. SU13CV0381-SW. As Krehn was riding her bike down the hill, Lillian Grant, a deacon from the church, pulled out in front of her on her left side. Despite her efforts to avoid an accident by breaking, Krehn struck the van according to court documents. She sustained injuries when her head went through the passenger side window, breaking the glass and severely cutting her face and neck. She was treated at Athens Regional Hospital, receiving emergency care after losing a significant amount of blood at the scene. According to Krehn and court documents, medical bills resulting from the accident totaled $31,000.
“Our firm worked very diligently on this case,” said Christopher Simon, an experienced Atlanta accident attorney. “There was a $1 million policy in place for the church but since the driver was outside the course and scope of her employment, the jury would only see Jade versus and nice old lady at trial. The outcome was fair and just, and I’m happy our client received the compensation she deserves.”
Initially, the firm made a demand for the $1 million policy limits according to court documents. The two parties agreed to mediate the case with Tom Tobin to negotiate a settlement but were unable to come to an agreement as to how much Krehn would receive for medical expenses and pain and suffering.
While Cole’s final official offer was $250,000. The Simon Law Firm believed that a jury trial would be willing to award between $500,000 and the $1 million policy limit, so they declined. In May of 2013, Atlanta wrongful death attorney Simon filed a suit on behalf of Krehn and prepared for trial.
“Thankfully, we were able to secure substantial compensation for Xaunna.” says Simon. “She can now continue her studies at the University of Georgia and fulfill her dream of becoming a Doctor.”
