DENVER – Mohammed Wali Zazi appeared in U.S. District Court in Denver this afternoon where he was advised by U.S. Magistrate Judge Michael J. Watanabe of the charges pending against him. Zazi faces charges in the Eastern District of New York of conspiracy to obstruct justice. The defendant was present with his court appointed attorney, a federal public defender. Now that Zazi is charged in New York, the U.S. Attorney’s Office in Colorado has filed a motion asking Senior U.S. District Circuit Judge David M. Ebel to dismiss the local charges pending against him.
Zazi through his attorney waived his right to a detention hearing and an identity and removal hearing. Zazi did, however, reserve his right to contest detention was in the Eastern District of New York. He did not contest detention, so he will remain in custody without bond pending a resolution to the case. He also waived his right to identity and removal hearings, essentially agreeing to allow the court to order Zazi removed from Colorado to New York by U.S. Marshals.
Mohammed Zazi was arrested recently by FBI Agents without incident after the Eastern District of New York indictment was returned.
These charges are only allegations and the defendant is presumed innocent unless and until proven guilty.
