Zone Perfect Diet Businessman Pleads Guilty to Tax Evasion

LAWFUEL – Edward J. Fasano, 54, pled guilty to one count of payroll tax evasion in the Central Islip Courthouse in Long Island, New York. Fasano is the owner and operator of Platinum Fitness Lifestyle, doing business as Zone Perfect Fresh Food Delivery, which was located on Smithtown Boulevard, Nesconset, N.Y. He pled guilty before Federal District Court Judge Joanna Seybert for not paying the IRS $467,484 in payroll taxes during the three month period April through June 2003. It was revealed in court that although he pled guilty to just one count, he owed up to $2.4 million in payroll taxes from 2002 through 2004. Fasano faces up to 5 years imprisonment, 3 years supervised release and up to a $250,000 fine. He will have to file accurate and correct personal tax returns for the period 2001 through 2004 and accurate and correct corporate tax returns for 2002 through 2004.

Although Fasano had his company in Nesconset, N.Y., he has since moved to Santa Monica, California and has started a music business. He was released on an unsecured bond and is free while waiting sentencing. He is scheduled to be sentenced on October 17, 2008.

The Eastern District of New York is prosecuting this investigation.
