11 August – LAWFUEL – The Law News Network – R. Alexander Acosta, United States Attorney for the Southern District of Florida, and Michael S. Clemens, Special Agent in Charge, Federal Bureau of Investigation, announced that defendant, Dwight McMillan, was sentenced today by United States District Court Judge William Zloch to 188 months’ incarceration and three years’ supervised release after having entered a guilty plea on May 27, 2005 to one count of interstate distribution of child pornography by means of a computer, in violation of Title 18, United States Code, Section 2252A.

According to court documents, on August 13, 2004, an FBI agent, operating in an undercover capacity, requested membership and gained access to a Yahoo group. The undercover officer discovered that the group contained images of child pornography. The investigation revealed that one of the users of the group, McMillan, had posted forty-three (43) images of child pornography on June 26, 2004.

On October 6, 2004, a federal search warrant was executed at McMillan’s residence in Pembroke Pines, Florida. Court records reflect that during the search, agents seized McMillan’s computer hard drive and numerous compact disks. A forensic analysis of the computer hard drive and the compact disks revealed that the defendant had more than 10,000 images of child pornography. Further analysis confirmed McMillan’s June 26, 2004 distribution on the Internet of the forty-three (43) images of child pornography. According to documents filed in court, McMillan was present during the search and admitted to posting approximately two-hundred (200) images of child pornography on the Internet and to possessing over 1000 images of child pornography.

Mr. Acosta commended the investigative efforts of the Federal Bureau of Investigation. This case is being prosecuted by Assistant United States Attorney Robin Waugh.
