26 October 2004 LAWFUEL – Law, legal, crime, law firm newsMarcos Daniel Jiménez, United States Attorney for the Southern District of Florida; and Julie Torres, Special Agent in Charge, Bureau of Alcohol, Tobacco, Firearms, and Explosives, announced today that defendant, Wade Whitehurst, was convicted by a federal jury on October 22, 2004, after a three-day trial on the charge of being a felon in possession of ammunition, in violation of Title 18, United States Code, Section 922(g)(1). Whitehurst faces a maximum statutory term of imprisonment of ten (10) years.
Whitehurst was arrested on May 19, 2004, after neighbors called local police to report a man firing a semi-automatic handgun on a N.W. Miami residential street that was crowded with children who had been released from school. At trial, a government witness identified Whitehurst as the person who fired the gun, an Intratec 9 millimeter pistol, loaded with a 30-round clip of 9 millimeter ammunition at a group of juveniles that Whitehurst believed had fought with his son. The witness testified that Whitehurst was the only person on the street with a firearm.
Mr. Jiménez commended the investigative efforts of the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and the Miami-Dade Police Department. The case is being prosecuted by Assistant United States Attorneys Scott Ray and Karlyn Hunter.
