Santa Ana, CA – LAWFUEL – Law News Network – A federal grand jury in Santa Ana returned an indictment this morning charging Joseph R. Drezek with willfully making and subscribing to a false United States Income Tax Form 433-A, Collection Information Statement for Wage Earners and Self-Employed Individuals.

According to the indictment, on or about February 25, 2005, Drezek filed the Form 433-A, Collection Information Statement, with the Internal Revenue Service. On the form, Drezek verified by a written declaration that the Form 433-A he filed was correct as to every material matter, under penalty of perjury. When he filed the form, Drezek allegedly knew that the Form 433-A contained false information; specifically, the fact that he had purchased, owned, and partially financed a 1999 Ferrari 360, worth in excess of $100,000. Drezek is accused of failing to disclose his ownership interest on the form.

The Form 433-A, Collection Information Statement for Wage Earners and Self-Employed Individuals, is used by the IRS in collection activities for disclose of taxpayer personal, business, and employment information. Taxpayers are to disclose financial matters such as their banking, investment, credit, and life insurance activities on these forms. Assets and liabilities as well as monthly income and expense information are additionally disclosed on these forms, submitted by taxpayers to the IRS.

If convicted of the charges in the indictment, Drezek could face a statutory maximum of 3 years in federal prison as well as a fine of up to $100,000.

This indictment is a result of an investigation conducted by IRS Criminal Investigation and the United States Attorney’s Office in Santa Ana.
