Ms. Yu represents employers in employee benefits litigation, with a particular emphasis on defending claims under the Employee Retirement Income Security Act (ERISA). “We are very pleased to have Kay join our practice group,” said Robert L. Hickok, chairman of Pepper’s Commercial Litigation Practice Group. “She brings strong experience handling complex ERISA litigation, including individual claims and class actions.” Andrew J. Rudolph, chairman of Pepper’s Employee Benefits Practice Group, added, “This is a critical element of the benefits practice, and Kay complements the group’s work. Our benefits, labor and employment, and commercial litigation groups work closely together, and Kay adds significantly to the depth of our joint efforts.” Ms. Yu’s experience includes ERISA claims involving traditional pension plans, cash-balance plans, executive compensation plans, and various health and welfare benefit plans. She counsels clients on such issues as standing, preemption, standards of review, fiduciary obligations, interpretation of plan terms, contingent workers, discrimination, and the interface of ERISA and claims asserted under the Age Discrimination in Employment Act and the Americans with Disabilities Act. Ms. Yu speaks frequently on ERISA topics. She is a member of the Defense Research Institute, Inc. and the American Bar Association, and is actively involved with the Employee Benefits Committee of the Labor and Employment Law Section of the ABA. Before joining Pepper, Ms. Yu was of counsel at Morgan, Lewis & Bockius LLP in Philadelphia. She received a B.A. from Columbia College, Columbia University in 1988, and her J.D. from Georgetown University Law Center in 1993. She is admitted to practice in Pennsylvania and Connecticut.
