PHOENIX – LAWFUEL- The Law News Network – David Andrew Bauer, 53, of Glendale, Ariz. and a former employee of the
Arizona Attorney General’s Office, was sentenced here today to 366 days in prison by U.S. District Judge Roger G. Strand. Bauer pleaded guilty on May 3, 2005 to Theft Concerning Government Programs Receiving Federal Funds. Once the Bureau of Prisons determines in which facility he will serve, Bauer will be required to self surrender to the U.S. Marshal’s Service to begin serving his prison term.
U.S. Attorney Paul K. Charlton stated that “Bauer abused the public’s trust. As a result he lost his job, his reputation and now his liberty. We will continue to relentlessly pursue corrupt officials.”
Bauer, while an investigator for the Arizona Attorney General’s Office, embezzled
approximately $81,750 in case funds. He deposited those official funds into his personal accounts and used the funds for his own benefit and not for the purposed he claimed to the Arizona Attorney General’s Office, specifically purported payments to confidential informants and the purchase of contraband, including the supposed undercover purchase of narcotics.
The investigation in this case was conducted by the Federal Bureau of Investigation. The prosecution was handled by Karen S. McDonald, Assistant U.S. Attorney, District of Arizona, Phoenix.
