SAN FRANCISCO, Feb. 2, 2006 -- Netbula, LLC, a software company specializing in Internet development tools, announced that it filed a lawsuit against Symantec Corporation and certain known and unknown individuals and companies. The suit, filed in the United States District Court for the Northern District of California in San Francisco, alleges that Symantec and BindView Development Corporation, which was recently acquired by Symantec, infringed Netbula's Copyrights. Netbula is a global leader in the development of innovations in "Remote Procedure Call" ("RPC") development tools. Netbula's main product line is its "PowerRPC" echelon, a cross-platform client/server development toolkit for Windows 98/NT/2000/ME/XP/2K3, UNIX and Java. Netbula's customers include many Fortune 100 companies. In its complaint, Netbula alleges that Symantec and BindView have engaged in copyright infringement and unfair conduct. Symantec and BindView's acts include: 1) infringing Netbula's core technology in at least part of the bv-Control Suite, 2) attempting to defraud Netbula through concealment of the scope of the infringement, and 3) breaching a contract with Netbula. Netbula's lawsuit seeks an injunction and damages. Netbula's lawsuit also requests identification of customers who have received the infringing software from Symantec/BindView. "Respect for intellectual property is the foundation of the commercial software industry to which both Symantec and Netbula belong," a Netbula spokesperson said. "We believe the Court will vindicate our IP rights." The lead attorney representing Netbula in this case is Neil A.
