20 February – LAWFUEL – The Law News Network – R. Alexander Acosta, United States Attorney for the Southern District of Florida, and Mark R. Trouville, Special Agent in Charge, Drug Enforcement Administration (DEA), announced that defendant, Andrew Weiss, of Boca Raton, Florida, pled guilty today in West Palm Beach in Case No. 05-80138-Cr-Hurley before U.S. District Court Judge Daniel T. K. Hurley. Weiss pled guilty to four counts of illegally dispensing Oxycontin outside the course of professional medical practice and not for a legitimate medical purpose, in violation of Title 21, United States Code, Section 841(a)(1).

Weiss faces a statutory maximum punishment of twenty (20) years in prison and a $1,000,000 fine on the drug charges. Weiss also agreed to forfeit $200,000 in cash derived from the scheme. Weiss was a medical doctor who practiced pain management medicine in West Palm Beach.

Weiss participated in a distribution ring that operated between Florida and Vermont for several years. As stated in court, the Government had linked nearly 15,000 Oxycodone tablets caused to be illegally dispensed by Weiss during the course of the conspiracy. According to Court records, the Oxycontin in this case was obtained illegally from Weiss while he worked under either St. Lucie Pain Center, or Pain Management of the Palm Beaches. Weiss illegally issued Oxycontin prescriptions in the names of real persons who were not his actual medical patients. The prescriptions were then filled, and the Oxycontin was sent to Vermont for illegal street sales.

Mr. Acosta commended the investigative efforts of the DEA. The case is being prosecuted by Assistant United States Attorney Steve Carlton.
