Kilpatrick Stockton’s Mark Levy to Argue Before the Supreme Court

WASHINGTON, DC (October 6) -- Kilpatrick Stockton announced today that Mark Levy, Chair of the firm’s Supreme Court and Appellate Advocacy Group, will be arguing his sixteenth case before the U.S. Supreme Court on Tuesday, October 7. Mr. Levy is representing the Respondent, DuPont Plan Administrator in Kennedy v. DuPont Plan Administrator, Docket No. 07-636. The Court granted certiorari to review whether the Fifth Circuit is correct in concluding that the Qualified Domestic Relations Order provision, 29 U.S.C. § 1056(d)(3)(B)(i), in the Employee Retirement Income Security Act (ERISA), is the only valid way a divorcing spouse can waive her right to receive her ex-husband’s pension benefits under ERISA. The National Law Journal recently included Mr. Levy in the “ ‘who’s who’ of Supreme Court bar veterans arguing this term.” Mr. Levy, who has been involved in well over 100 cases on the merits before the Court, served as Deputy Assistant Attorney General in the Civil Division at the Department of Justice in the Clinton Administration and previously was an Assistant to the Solicitor General. He is a member of the Advisory Committee for the Federal Rules of Appellate Procedure and on the adjunct faculty at the University of Virginia Law School. He is also a Fellow of the American Academy of Appellate Lawyers and a Master in the Edward Coke Appellate American Inn of Court. Mr. Levy is also an appellate columnist for National Law Journal and is frequently quoted by some of the world’s leading news organizations.
