Boston – 21 March 2005 – LAWFUEL – The Law News Network – Foley & Lardner LLP announced today that J. Mark Waxman, president and general counsel of CareGroup, Inc. in Boston will rejoin the Firm as a partner in the Health Law Department. Mr. Waxman, 55, will be resident in the Firm’s Boston office effective April 1.

Mr. Waxman joined CareGroup, a nonprofit health care system which includes Boston’s Beth Israel Deaconess Medical Center academic health center, three community hospitals and multiple physician organizations, in February 2000. During his tenure, CareGroup engaged in a unique turnaround, selling non-productive assets, reforming its non-profit Board structures, engaging with state and federal regulators, and ultimately returning to financial health in a new confederation model of nonprofit system activity.

Immediately following his return to Foley & Lardner, Mr. Waxman will lead the Firm’s national efforts to provide legal and business counseling to universities, academic medical centers and research organizations.

“Having served as president and general counsel of CareGroup, Mark will bring a unique perspective and broad range of experiences to the Firm’s clients and health law attorneys,” said Jody Root, chair of the Firm’s Health Law Department. “His background will provide a strong platform from which we can focus our efforts to provide services to the academic medicine community.”

Prior to joining CareGroup, Mr. Waxman was a partner in both the Los Angeles and Washington, D.C., offices of Foley & Lardner. He chaired the Firm’s mid-Atlantic and eastern United States health law practice. His practice included a wide variety of matters relating to the operation of health care providers and facilities, including formation of integrated delivery systems, general business planning, the antitrust implications of mergers and acquisitions, federal program fraud and abuse, operational issues and managed care contracting. Mr. Waxman was involved in litigating technology-related matters in the Life Sciences area as well. He also served for over six years as the general counsel to the California Association of Health Facilities. Before joining Foley & Lardner, Mr. Waxman was an assistant United States attorney for the Central District of California.

Mr. Waxman has served as a board member of RMF/CRICO, a captive insurer and a member of its Intellectual Property Committee, a board member of the Harvard Clinical Research Initiative and chair of the Picker Institute.

Mr. Waxman is a vice-chairman of the ABA Health Law Section Medical Research, Technology and Ethics Subcommittee. He was a member of the American Hospital Association’s Task Force on Antitrust and Business Coalitions and of the board of directors of the American Health Lawyers Association. Mr. Waxman also is a member of the BNA Health Law Reporter Advisory Board, BNA Medical Research Law & Policy Reporter Advisory Board, IRB Advisor Editorial Board, the American Health Lawyers Association, and the Healthcare Financial Management Association.

Mr. Waxman received his juris doctorate from the Boalt Hall School of Law at the University of California, Berkeley, where he was articles and book review editor of the Ecology Law Quarterly. He also received a bachelor of arts, summa cum laude, from the University of California, San Diego.
