June 29, 2004 – LAWFUEL – Marcos Daniel Jiménez, United States Attorney for the Southern District of Florida; and Jesus Torres (Miami) and Roberto G. Medina (Puerto Rico), Special Agents in Charge, of the Department of Homeland Security, U.S. Immigration & Customs Enforcement, announced today that defendant, David Tomkins, has pleaded guilty to an Indictment charging him with conspiring to violate the Arms Export Control Act, in violation of Title 22, United States Code, Section 2778, and Title 18, United States Code, Section 371.

Tomkins, a native of England, was charged with conspiring to export a Dragonfly A37 turbojet light-attack aircraft from the United States in 1991 without first obtaining an export license. At a hearing this morning before United States District Judge Adalberto Jordan, Tomkins admitted his participation in the scheme. Tomkins faces a maximum term of imprisonment of five (5) years and a maximum fine of $250,000. Tomkin’s sentencing hearing is set for September 21, 2004.

Mr. Jiménez commended the efforts of the Department of Homeland Security, U.S. Immigration & Customs Enforcement. The case is being prosecuted by the Assistant United States Attorney John Schlesinger.
