LAWFUEL – Legal Newswire – Hunton & Williams LLP announced today the US release of the second edition book European Data Protection Law: Corporate Regulation and Compliance by internationally renowned privacy lawyer Christopher Kuner, a partner in the firm’s Brussels office. The book presents a comprehensive and updated overview of European data protection law and its impact on companies. The book also examines important legal developments in the EU privacy arena that have taken place since the first edition in 2003.

“Privacy laws around the world are continually changing and there are broad differences between EU and US laws,” said Marty Abrams, the Executive Director of The Center for Information Policy Leadership at Hunton & Williams. “Since its first edition, European Data Protection Law has been an acclaimed, single reference source for companies facing data protection issues.”

“It is critical for anyone engaged in commerce in Europe to understand the complexities of cross-border data protection laws,” explains Kuner, who heads the European Privacy Practice of Hunton & Williams and is Chair of the International Chamber of Commerce Data Protection Task Force. “While the European Privacy Directive serves as a guideline for EU nations, each country also has its own national law and an agency that interprets that law. The book aims to navigate through these issues and cite noteworthy cases that have helped set the tone for privacy laws.”

New Issues and Cases

The book covers a wealth of new information and updated cases in the field of privacy, including:

The first three cases in which the European Court of Justice interpreted the EU Data Protection Directive (95/46), and the Commission’s first report on the implementation of the Directive
The Data Retention Directive
New developments in international data transfers, and conflicts between security requirements and data protection
The implementation of the Electronic Communications and Privacy Directive 2002/58 in the Member States
The recent European Court of Justice decision on the controversial export of airline passenger data to the US
An expanded European overview of new and acceding Member States
The use of binding corporate rules (for international data transfers)
Expanded appendices that include most of the privacy sources a company will need, such as the texts of relevant directives, the safe harbor principles and Frequently Asked Questions, and charts of implementation in the Member States of specific provisions of interest to business
“Privacy enforcement issues across the EU have intensified since the last edition of the book, and new issues have emerged that have brought to light some of the conflicting regulations of US and EU laws,” said Kuner. “Companies can no longer take a ‘wait and see’ approach to privacy issues – they must proactively monitor these risks to ensure they have appropriate policies, procedures and plans in place.”

Book Reviews

The first edition of the book was considered by privacy experts as the European Bible of privacy law. First edition reviews included:

Computer and Telecommunications Law Review said: “…opens the reader’s eyes to the Europe-wide, indeed the worldwide issues at stake in the future of data protection law; and serves as a cautionary tale for those who would confine themselves to the parochial charm of a national registry’s guidance notes.”

ASIL Newsletter (American Society of International Law) said: “A useful addition to the literature on the European data privacy debate, which has huge repercussions for any global or cross-border enterprise failing to accord sufficient attention to the issues.”
