Morrison Kent Fail To Strike Out Negligence Claim

An attempt to strike out a negligence claim by Morrison Kent and relating to a troubled property development partnership has failed in the High Court in Auckland.

The claim against the firm has been brought by Premier Legal Finance who is suing the firm for alleged breaches of duties of care.

The property partnership at the centre of the claim involved the liquidated company MR8 Construction, headed by bankrupt director Mark Ensom, a client of Morrison Kent and who were involved in property developments in Grey Lynn.

MR8 Construction’s projects had involved developments at Farro Orakei and residential work in Mt Eden, Ponsonby and Flat Bush as well as Fitzroy Street, Ponsonby.
