Philadelphia, PA – September 8, 2004 LAWFUEL – Best for law, law news, legal news, law research, attorneys – Pepper Hamilton LLP announced that Kay Kyungsun Yu has joined the firm as a partner in the Commercial Litigation Practice Group in the Philadelphia office. Ms. Yu represents employers in employee benefits litigation, with a particular emphasis on defending claims under the Employee Retirement Income Security Act (ERISA).

Our benefits, labor and employment, and commercial litigation groups work closely together, and Kay adds significantly to the depth of our joint efforts.”

Ms. Yu’s experience includes ERISA claims involving traditional pension plans, cash-balance plans, executive compensation plans, and various health and welfare benefit plans. She counsels clients on such issues as standing, preemption, standards of review, fiduciary obligations, interpretation of plan terms, contingent workers, discrimination, and the interface of ERISA and claims asserted under the Age Discrimination in Employment Act and the Americans with Disabilities Act.

Ms. Yu speaks frequently on ERISA topics. She is a member of the Defense Research Institute, Inc. and the American Bar Association, and is actively involved with the Employee Benefits Committee of the Labor and Employment Law Section of the ABA.

Before joining Pepper, Ms. Yu was of counsel at Morgan, Lewis & Bockius LLP in Philadelphia. She received a B.A. from Columbia College, Columbia University in 1988, and her J.D. from Georgetown University Law Center in 1993. She is admitted to practice in Pennsylvania and Connecticut.

Pepper’s ERISA and Pension Litigation Group, a section of the firm’s Commercial Litigation Practice Group, represents fiduciary liability insurers, plan insurers, service providers, multi-employer plan trustees and plan sponsors in all aspects of ERISA and pension litigation, including benefits claims, breach of fiduciary duty claims, discrimination claims, and issues relating to preemption, qualified and non-qualified benefit plans, prohibited transactions, executive compensation, IRAs, ESOPs, profit-sharing, 401(k) plans and multi-employer plans, and withdrawal liability. Lawyers in the group work closely with the firm’s Employee Benefits Practice Group and the Labor and Employment Practice Group.

The Employee Benefits Practice Group assists employers with the design, implementation, operation and termination of benefits and compensation programs, including executive compensation programs, qualified and non-qualified retirement plans and health and welfare benefit plans, and the benefits and compensation aspects of corporate transactions such as mergers and acquisitions.
