Tuesday 10 October 2006 LAWFUEL – Law News, Law Jobs – Eight-five company officers around Australia have been prosecuted over the last three months following complaints filed with the Australian Securities and Investments Commission (ASIC). The successful prosecutions involved 158 contraventions of the law and resulted in fines and costs of more than $199,112 being imposed.
These prosecutions follow complaints received from the general public and business community and relate to a range of Corporations Act contraventions. ASIC has taken action on the failure of company officers to assist liquidators and administrators in the administration of their failed companies, as well as officers and their companies failing to update ASIC registers with the addresses of their companies and company officers in an attempt to hide from creditors.
Mr Greg Tanzer, ASIC Executive Director of Consumer Protection, said these latest figures showed why it is vital that the public continue to contact ASIC with their complaints and concerns. ‘The failure of small companies and their directors to comply with basic requirements harms creditors and consumers and makes it difficult for company liquidators to recover property for creditors’, Mr Tanzer said.
‘These prosecutions are an important part of ASIC’s work, and clearly show that ASIC focuses on the corporate conduct of businesses and individuals across Australia, at all levels’, Mr Tanzer said.
