9 December 2004 -LAWFUEL – First for law news – Marcos Daniel Jiménez, United States Attorney for the Southern District of Florida; and Michael S. Clemens, Special Agent in Charge, Federal Bureau of Investigation, announced that United States District Court Judge Paul C. Huck recently sentenced defendant, Giovanni Felipe, a retired City of Miami firefighter, to a term of imprisonment of forty-six (46) months for receipt and possession of child pornography. Judge Huck also sentenced Felipe to a term of supervised release of three (3) years and to complete three hundred (300) hours of community service per year if unemployed. Judge Huck ordered Felipe to pay a $5,000 fine.

During the course of trial, Felipe pleaded guilty to two (2) counts of a Superseding Indictment, which charged him with possession of child pornography, in violation of Title 18, United States Code, Section 2252A(a)(5)(B), and receipt of images involving the sexual abuse of a minor, in violation of Title 18, United States Code, Section 2252(a)(2). Items found on Felipe’s computers included numerous pornographic images involving children under the age of twelve (12) and images involving sadistic conduct or other depictions of violence. Thirty-five (35) images were specifically listed in the Superseding Indictment.

Mr. Jiménez commended the investigative efforts of the Federal Bureau of Investigation and the National High Tech Crime Unit of England and Wales and New Scotland Yard. The case is being prosecuted by Assistant United States Attorney Marie Villafa*a.
