Former Head of McDermott, Will & Emery LLP New York Health Law Practice Joins Expanding Health Law Section

Andrew B. Roth, the former head of McDermott, Will & Emery’s New York Health Law Practice, and David S. Ivill, also a former partner at McDermott, Will & Emery, have joined Mintz Levin’s Health Law Section as Members. Nili S. Yolin has joined as an associate.

Mr. Roth’s extensive experience covers the representation of a wide array of clients in the health industry, both on the provider side (including multi-hospital systems and individual hospitals of all sizes, nursing homes and physician groups), and on the payor side (including managed care companies, HMOs and prepaid health service plans). He is active in health industry mergers and acquisitions, and the establishment of joint ventures and other collaborative affiliations. In the regulatory area, he counsels clients in connection with corporate compliance and corporate governance, fraud and abuse, hospital-medical staff matters, HIPAA and Medicare/Medicaid matters. Mr. Roth’s graduate medical education clients include many prestigious academic medical centers, as well as other teaching institutions, across the United States.

A frequent speaker on a wide range of health law issues, Mr. Roth has appeared before many professional organizations, including the American Health Lawyers Association, Greater New York Hospital Association, the Association of Program Directors in Surgery and the Association of Hospital Medical Educators, among others. He also has written articles, book chapters and texts that have appeared in a variety of legal and health industry journals and other publications.

In 2006, Chambers and Partners recognized Mr. Roth as a leading health care lawyer in New York in its publication, Chambers USA: America’s Leading Lawyers for Business.

Mr. Roth is a graduate of the State University of New York at Stony Brook, and earned his law degree from Hofstra University School of Law, where he was a member of the Hofstra Law Review. He is admitted to practice in New York and Washington, D.C.

Mr. Ivill is an accomplished attorney with expertise in many areas of health law, including the representation of not-for-profit and tax-exempt organizations in numerous types of transactions, and providing counseling to health care institutions on corporate, transactional and regulatory matters. Mr. Ivill has particular expertise in working with federally qualified health centers, disproportionate share hospitals, and the Section 340B federal drug pricing program. He represents hospitals, long term care facilities and other health care providers. He also has a broad physician-based practice, representing physicians and medical groups in joint ventures and other transactions, as well as fraud and abuse, and other regulatory matters.

After receiving his bachelor’s degree from Westminster College, Mr. Ivill graduated from the Pennsylvania College of Podiatric Medicine and practiced podiatric surgery for more than ten years. He thereafter obtained his law degree from New York University School of Law, where he served as Articles Editor for the Review of Law and Social Change. He is a member of the bars of the States of New York and Connecticut.

Ms. Yolin’s health law practice focuses on corporate, transactional and regulatory compliance matters. She regularly counsels clients on corporate governance, licensure issues, medical staff matters, fraud and abuse, and HIPAA. She also is active in working with teaching hospital clients on accreditation issues involving their graduate medical education programs.

Ms. Yolin is a member of the New York bar. She is a graduate of New York University and Brooklyn Law School, where she was a Second Circuit Review Editor for the Brooklyn Law Review.
