Kilpatrick Stockton partner Randy Edwards led a three
lawyer trial team in Fulton County Superior Court that secured a jury award of
approximately $3.8 million for client Hahn Yalena Corporation — $595,584.10 in
compensatory damages and $3,189,566.20 million in punitive damages.

Hahn-Yalena, a small gas utility contractor from Pennsylvania, sued Infrasource,
Inc. f/k/a Exelon Infrastructure Services, Inc., for fraud and concealment in
connection with a potential acquisition of Hahn Yalena in 1999. Infrasource is
one of the nation’s largest providers of energy and telecommunications
infrastructure construction services. Hahn-Yalena claimed that Exelon duped
Hahn-Yalena into helping Exelon obtain large and lucrative construction
contracts for Atlanta Gas Light (AGL), all under the representations that Exelon
was going to acquire Hahn Yalena as its underground gas construction “Platform”
company. While Hahn Yalena was working with Exelon for AGL, and successfully bid
on future work with AGL, (Exelon did not posses the necessary license), Exelon
had secretly signed a letter of intent with one of Hahn-Yalena’s direct
competitors to be Exelon’s “Platform” company, rather than Hahn Yalena.
