24 June – LAWFUEL – The Law News Network – R. Alexander Acosta, United States Attorney for the Southern District of Florida, and Mark R. Trouville, Special Agent in Charge, Drug Enforcement Administration, announced today that defendant, Monroe Schiffman, was sentenced to forty-six (46) months’ imprisonment, to be followed by four (4) years of supervised release for selling the narcotic drug hydrocodone without a prescription and making false statements to the DEA in his pharmacy’s application for registration with DEA. Schiffman sold the drug at his 9th Avenue Pharmacy, located in the Sistrunk area of Fort Lauderdale, Florida. United States District Court Judge James I. Cohn also ordered that Schiffman forfeit $300,000 of drug profits to the United States and barred Schiffman from practicing pharmacy during the period of supervision following his imprisonment.
According to the criminal complaint and Information filed by the United States Attorney, Schiffman sold the narcotic drug hydrocodone without a prescription on a number of occasions from October 2003 to November 16, 2004, when Schiffman was arrested. During the undercover DEA investigation, Schiffman sold hydrocodone, the narcotic drug found in Lorcet and Vicodin, to an undercover agent and a cooperating witness for cash on multiple occasions, each time without prescriptions. Subsequently, an audit of the pharmacy’s records confirmed that the pharmacy had hundreds of thousands of unaccounted doses of hydrocodone-containing drugs.
Mr. Acosta commended the investigative efforts of the Drug Enforcement Administration. The case was prosecuted by Assistant United States Attorney Robert N. Nicholson.
