August 3, 2004 Today’s legal news, law news, law firm news & research at LAWFUEL The lawyers selected for the Legal Elite represent fewer than 2% of Florida’s resident bar members and were chosen after a peer review of all members of the Florida bar. Lawyers were asked to name up to ten lawyers whom they held in the highest regard, of whom not more than half could be from their own firm. Votes from lawyers not in the same firm were given three times the weight of votes by colleagues, and the results were tabulated to produce the finalists.
David A. Beyer, who was selected in the area of Antitrust and Trade Regulation, concentrates his practice in the area of franchise and distribution and other sales and distribution methods, with special focus on counseling on the impact of antitrust and trade regulation laws. Mr. Beyer is a leader in the development of franchise law in Florida. He has served multiple terms as chairman of the Franchise Law Committee of the Florida Bar. In that role, he has led successful efforts both to improve franchise laws in Florida and defeat destructive proposed legislation.
Mr. Beyer speaks and writes on various franchise, distribution, and business law topics. He has served as a panelist for the International Franchise Association Roundtables and Annual Legal Symposiums, and the American Bar Association’s Annual Franchise Forum. A frequent author, his articles have appeared in the Vanderbilt Law Review, the ABA Franchise Law Journal, the Florida Bar Journal, the IFA Franchise Legal Digest, Franchising World, the Florida Bar Quarterly Report, FranCast, and Dispute Resolution Times . Mr. Beyer coauthored chapters on franchise law topics in The Franchise Desk Book (an ABA publication), and is a contributing author to Franchise Law and Practice, a 1993 publication of the Florida Bar.
Frederick H. L. McClure, who was selected in the area of Civil Trial practice, is an experienced litigator and conflict resolution specialist. He is rated “AV,” the highest rating attainable, by Martindale-Hubbell Law Directory. His broad-ranging experience includes:
• Labor and Employment Litigation: Mr. McClure defends both public and private sector clients in all types of employment-related litigation, arbitration and mediation, such as claims of discrimination and sexual harassment, claims under the ADA and FMLA, Title IX of the Education Amendments Act of 1972, and employment related torts, such as defamation and invasion of privacy.
• Product Liability: In his product liability practice, Mr. McClure has represented both domestic and international manufacturers, and has successfully defended products in the automotive electronics, cosmetics, food and asbestos industries.
• Class Action Litigation.
• Insurance Coverage and Bad Faith: Mr. McClure has served as regional counsel for a major insurance carrier in the prosecution and defense of coverage and bad faith claims
• Higher Education Compliance: Mr. McClure counsels institutions of higher learning with respect to issues under Title IV (financial aid) of the Higher Education Resources and Assistance Act and Title IX (sexual harassment and gender discrimination) of the Education Amendments Act of 1972, as well as the defense of such claims in administrative and court tribunals.
Mr. McClure, who was born and raised in Chattanooga, practiced with the Chattanooga law firm of Grant Konvalinka & Harrison, PC, until he moved to Florida in 1998. While practicing in Chattanooga, Mr. McClure served for 10 years as a member and board officer of the board of commissioners of the Chattanooga Housing Authority, the Chattanooga Area Chamber of Commerce and The Carter Street Corporation, among other civic activities. Mr. McClure is also a former president of the Chattanooga, Tennessee and American Bar Association’s Young Lawyers Divisions.
