3 December – LAWFUEL – The Law News Network – Thelen Reid chairman Stephen V. O’Neal and Construction partner Paul W. Berning have co-authored the chapter on construction litigation for the critically acclaimed Second Edition of Business and Commercial Litigation in Federal Courts. This eight-volume, strategy-oriented treatise is the result of a joint project between the American Bar Association’s Section of Litigation and Thomson West. Mr. O’Neal and Mr. Berning are among 199 principal authors of the Second Edition, including 17 federal judges and many of the finest litigators in the U.S.

The First Edition, published in 1998, received more than 130 favorable book reviews in bar journals and legal newspapers throughout the United States. It has been widely recognized as a unique and invaluable resource and has become the definitive reference work on corporate and commercial litigation.

The Second Edition—to be released this month—greatly expands upon and updates the First with sixteen new chapters and two additional volumes. Altogether, the new edition presents a step-by-step practice guide covering every aspect of a commercial case, from its inception, through pleadings, discovery, motions, trial and appeal. The treatise also contains 36 substantive law chapters, including the construction chapter co-authored by Messrs. O’Neal and Berning.

The construction litigation chapter provides an overview of the construction industry and the commercial issues unique to it; describes typical construction disputes and claims; and discusses how such cases are litigated in federal court. It includes procedural and practice checklists, checklists of essential allegations and defenses, sample forms and resource lists.

In addition to the in-depth text on law and procedure, the Second Edition includes numerous cross-references and special sections on strategies and client counseling. There are hundreds of pages of essential litigation forms and jury charges in print and on a CD-ROM that is included with the set.

Mr. O’Neal—who has served as chairman of Thelen Reid since April 1, 2005—has more than 25 years experience in construction, real estate and complex business litigation. He is recognized as one of the leading construction attorneys in the United States in Chambers USA Guide to America’s Leading Business Lawyers. He chaired Thelen Reid’s Construction Department for nearly a decade before being elected chairman of the firm.
