ATLANTA (JUNE 27) — Kilpatrick Stockton LLP announced today that the Court of Appeals for the Federal Circuit ruled that Knapp Logistics and Automation’s $15 million automated prescription vial filling system did not infringe a patent held by competitor AutoMed Technologies, Inc.

The case centered on claims by AutoMed that the automated prescription vial filling system Knapp sold to Kaiser Permanente infringed an AutoMed patent. The trial judge in the U.S. District Court for the Northern District of Georgia ruled in construing the patent claims that the patent should be interpreted in a way that meant that Knapp’s system could not infringe the patent. AutoMed appealed to the Federal Circuit, before which Kilpatrick Stockton Patent Litigation Partner Steve Moore provided oral argument in April 2007. The court issued a unanimous opinion on May 31 ruling that the trial court correctly interpreted the patent and rejecting all of AutoMed’s arguments.
