LAWFUEL – The Law News Network – On February 14, 2006, Berger & Montague won a verdict from a federal jury that could exceed $400 million on behalf of thousands of homeowners who had sued the former operators of the Rocky Flats nuclear weapons facility, Dow Chemical and Rockwell International.
The trial team was lead by shareholders Merrill G. Davidoff, Peter Nordberg, and David Sorensen. The case was tried over four months in a federal court in Denver, and the verdict was reached only after the ten-person jury deliberated for more than two weeks.
The case was originally filed fifteen years ago as a class action. The suit claimed that Dow and Rockwell negligently caused plutonium to blow off the plant site and contaminate thousands of nearby properties.
