NEW YORK, February 1, 2006 – LAWFUEL – The Law News Network – Orrick, Herrington & Sutcliffe LLP announced today that firm client Nikko Materials USA, Inc. was awarded more than $4.3 million in damages, attorneys fees, and other costs in its patent infringement case against R.E. Service Co., Inc. (RES). The award was granted on January 17, 2006, following a two-week trial in early 2005 in which a Northern California jury unanimously found that RES had willfully infringed Nikko?s patents.

The case was filed in May 2003 when Nikko asserted two patent infringements against RES. In response, RES asserted that Nikko had infringed four RES patents. Prior to trial, the court granted Nikko’s summary judgment motions, ruling Nikko did not infringe the RES patents. After the jury announced its verdict on April 11, 2005, the parties filed various post-trial motions and, on January 12, 2006, the court granted Nikko’s post trial motions and entered an immediate permanent injunction against RES.
