DALLAS, TEXAS — Settlement notices were mailed today to ninety-two security guards in the Lufkin, Texas area who are eligible to participate in an overtime settlement.
The settlement was approved by United States District Judge Ron Clark on July 9, 2008.
The lawsuit alleged that security guards were mispaid because overtime was only paid when guards worked over eighty hours in a two week period. The law requires that employees be paid when they work more than forty hours in any work week. By paying overtime based on a two week, rather than a one week period, the plaintiff alleged that security guards were mispaid.
Security guards have thirty days to return consent forms to participate in the settlement.
The lawsuit is styled Wilson v. Centurion Security Services, Civil Action No 9:07-cv-00170 and is pending in the United States District Court for the Eastern District of Texas.
