Yesterday, the hospitalization of
Justice William H. Rehnquist and his battle with thyroid cancer was made
public, bringing the urgency of the “judges issue” back into prominence just
eight days before our national elections. As we offer prayers for the health
of Mr. Rehnquist and the importance of his work; the need for
constitutionalists on our nation’s courts is highlighted once again. Tony
Perkins, President of Family Research Council released the following
statement:

“I don’t think it is too much to say that the culture may well hang in the
balance with the appointment of Supreme Court justices in the coming years.
The domestic security of our culture demands a President and Senate that will
fight aggressively for judges who strictly interpret the law.

“State Supreme Court Justices like Massachusetts Justice Margaret Marshall
are seen as overstepping the bounds of their constitutionally defined role and
forcing cultural change down the throats of unwilling citizens as Marshall did
with her ruling favoring same-sex ‘marriage.’ Democratic Presidential
candidate, John Kerry, has indicated a double litmus test for future Supreme
Court appointees in that he would not allow any judicial appointment opposed
to Roe vs. Wade or same-sex ‘marriage.’

“The battles we have faced on the home front are not just from a foreign
enemy but from our own courts that have become activist bodies re-defining our
values and shaping our culture against the will of the American people and our
democratic process.

“Cultural engineering has no place in our court system and Justice
Rehnquist has done the nation a great service during his time on the Court in
keeping the separation of powers in check.”
