NEW YORK, July 25, 2008 (LAWFUEL) — The Brualdi Law Firm, P.C.
announces that it has commenced an investigation of Lehman Brothers
Holdings, Inc. (“Lehman Brothers” or the “Company”) for potential
violations of the Employee Retirement Income Benefits Security Act of
1974 (“ERISA”). The investigation concerns investments in Lehman’s
stock in the Lehman Brothers Holdings, Inc. Savings Plan 401(k) (the
“Plan”).
The Brualdi Law Firm, P.C.’s investigation involves concerns that
Lehman Brothers and other administrators of the Plan may have breached
their ERISA-mandated fiduciary duties of loyalty and prudence to
participants and beneficiaries of the Plan. A breach may have occurred
if the fiduciaries failed to manage the assets of the Plan prudently
and loyally by investing the assets in Company stock when it was no
longer a prudent investment for participants’ retirement savings.
Specifically, the Brualdi Law Firm, P.C. is investigating whether
certain fiduciaries of the Plan may have breached their fiduciary
duties under ERISA to the Plan and its participants and beneficiaries
by continuing to invest the Plan’s assets in Lehman Brothers common
stock when it was no longer prudent to do so.
