Emory University School of Law will host the Kilpatrick Stockton Distinguished Lecture in IP: “Copyright Fair Use and The First Amendment” 7 to 9:30 p.m., Tuesday, October 18. The event will be held at the law school, 1301 Clifton Road, Atlanta.
The featured speaker will be the Honorable Stanley F. Birch, Jr. 70JD, 76LLM, of the 11th Circuit United States Court of Appeals. Birch will address the interplay of fair use under copyright law and the First Amendment’s free speech guarantee.
Birch began active service in 1990 on the U.S. Court of Appeals. A native of Atlanta, Birch distinguished himself as a practitioner of law in Gainesville, Georgia and in Atlanta with Vaughan, Davis, Birch & Murphy until he was nominated to the Court of Appeals by President George H.W. Bush. His practice focused on copyright law in the entertainment and computer software industries.
Birch was counsel to, and a business associate of, Xavier Roberts, the creator and owner of the Cabbage Patch Kids doll copyrights and trademarks. He litigated many of the first cases involving software copyright issues in the Southeast. Birch is co-author with Professor L. Ray Patterson of articles and a book on the law of copyright. He earned a law degree from Emory in 1970, and a master of laws in taxation in 1976. Birch served in the United States Army as a first lieutenant with the Army Special Forces and is a Vietnam War veteran. He continues to be an active force in the legal community. Birch served on Georgia Chief Justice’s Commission on Indigent Defense. He has been designated as a distinguished alumnus of Calvert Hall and the Emory Law School. Birch is also active in the alumni associations of The University of Virginia, Trinity College (Oxford), and the Peabody Conservatory.
