International Businessman Pleads Guilty To False Tax Return Filing – US Attorney

PHOENIX – LAWFUEL – Legal Newswire – Thomas Rikki Farr, 65, of Paradise Valley, Ariz., pleaded guilty to one felony count of Willfully Filing a False Income Tax Return this week. Farr was charged in an Information, a type of federal charging document, and acknowledged in his guilty plea that in 2004 his U.S. Individual Income Tax Return reported $3,820 for total income. Farr admitted that during 2004, he had received $743,346 in additional commission income from his association with Zylux Acoustic, Hong Kong, China, which should have been reported on his U.S. Individual Income Tax return.

Farr admitted that he knowingly and intentionally omitted the amount from his 2004 U.S. Individual Income Tax Return and also acknowledged that during 2005, he received $385,356.58 in additional commission income from his association with Zylux Acoustic, Hong Kong, China, which should have been reported on his 2005 U.S. Individual Income Tax Return.

The guilty plea occurred on June 10, 2008. Sentencing is set before U.S. District Court Judge Neil V. Wake on September 8, 2008. A conviction for Presenting False Tax Returns carries a maximum sentence three years in prison, a $100,000 fine or both. In determining an actual sentence, Judge Wake will consult the U.S. Sentencing Guidelines, which provide appropriate sentencing ranges. The judge, however, is not bound by those guidelines in determining a sentence.

The investigation preceding the guilty plea was conducted Special Agents of the Internal Revenue Service, Criminal Investigation Division. The prosecution is being handled by Richard I. Mesh, Assistant U.S. Attorney, District of Arizona, Phoenix.
