LAWFUEL – Legal News Network – Attorney General Eliot Spitzer today announced a settlement with an upstate mobile home retailer after consumers complained that it failed to timely and properly complete the installation of new homes and make repairs.

American Homes, which is operated by Kenn-Schl, LLC, agreed that it would complete installations and repair work within 60 days. In settling the matter, American Homes agreed to pay $7,000 in civil penalties and costs.

“Consumers should anticipate and receive properly installed new homes and expect that the retailer will stand behind its promises,” Spitzer said.

Since 2002, the Attorney General’s office has received at least 11 complaints from consumers alleging that they were made to wait months for repair work after the installation of their new mobile homes. The complaints included such problems as: two-year delays in repairing improperly installed doors; an 18-month wait to repair a leaky roof; homes delivered with dented and scratched soffits; and homes delivered with carpets having holes in them.

Specifically, American Homes agreed that all complaints and requests for repairs will be handled by its corporate office in order to ensure the work is completed in a timely and satisfactory manner. Also, American Homes agreed to complete all repair requests within 60 days. In the event a repair cannot be completed in that time frame, American Homes will notify the homeowner in writing with the reason. If after 30 additional days the repair work in not completed, the homeowner will be entitled to select another contractor to complete the repairs and be reimbursed by American Homes for the expense.

American Homes operates under a number of names including: American Homes in Richfield Springs, Brewerton, Harpursville and Weedsport; Camelot Homes in Westmoreland; Lake Country Homes/American Homes in Freeville; Carefree Housing of Gloversville and Utica; and Hudson Valley Homes in Cairo.
