LUBBOCK, TEXAS – LAWFUEL – Press Release Service – A state district court jury in Lubbock has awarded verdict of $944,420 in a medical malpractice lawsuit against a Lubbock, Texas, doctor who was found negligent for performing LASIK eye surgery on a patient who should never have had the procedure. The verdict represents one of Texas’ largest medical malpractice awards under new tort reform laws that were enacted in 2003.
Attorney Thomas J. Farmer, of The Law Offices of Frank L. Branson in Dallas, Texas, tried the case on behalf of Pamela Ware in her claims against Dr. James J. Boop, operator of the Boop Laser Eye Center in Lubbock.
Ms. Ware, 52, is a self-employed Certified Public Accountant who has worked in Lubbock for more than 25 years. She originally visited Dr. Boop on Nov. 13, 2001, for a consultation about whether she might be a candidate for LASIK laser eye surgery.
On Dec. 5, 2001, Dr. Boop performed the LASIK procedure on both of Ms. Ware’s eyes. Immediately afterward, Ms. Ware began experiencing severe vision problems. Dr. Boop then performed additional “enhancement” laser surgical procedures on Ms. Ware in June and July of 2002.
When her vision problems persisted, Ms. Ware went to another doctor who performed a corneal transplant in her left eye in May 2003 to correct some of the damage caused by the prior laser procedures. Although this corrective surgery was intended to improve her vision, Ms. Ware continues to suffer problems, and she is currently awaiting a corneal transplant in her right eye.
The jury of seven women and five men deliberated approximately four hours before delivering the verdict the evening of June 26, 2006. The jury’s decision followed five days of trial before 72nd District Court Judge Ruben G. Reyes of Lubbock.
