Jones Day attorneys Michael A. Carvin, Gregory A. Castanias, Esther Slater McDonald, Jennifer L. Swize of the Washington Office and Patricia J. Villareal of the Dallas Office won a victory for Dell,. Inc in a case challenging the constitutionality of nearly $250 million in financial incentives provided to Dell by the state of North Carolina.

In Blinson v. North Carolina, the plaintiffs, represented by the North Carolina Institute for Constitutional Law, asserted that a 2004 law providing tax incentives and other financial assistance to Dell in order to entice the company to build a manufacturing and distribution plant in the Winston/Salem-Greensboro area., violated both the state and U.S. constitutions.

On May 10, 2006 the court dismissed the case based on both the plaintiffs’ lack of standing and the claims lack of merit. Michael Carvin performed the oral argument.
