LAWFUEL – The Legal Newswire – The Age reports that music promoter Glenn Wheatley has won leave to appeal against his 30-month jail sentence for tax fraud offences.
Justice Alex Chernov allowed the appeal to continue after finding that grounds raising technical appeal points against the jail term were reasonably arguable.
Wheatley, 59, was not in court for today’s proceedings. No date was fixed for the hearing of the appeal.
Justice Chernov said the appeal grounds related to the structure of the sentence, and a failure by the sentencing judge to take account of changes to the relevant law.
The changes effectively reduced the maximum sentence for one of the three charges to which Wheatley pleaded guilty from a 10 years to five.
