NEW YORK, Feb. 27 LAWFUEL – The Law News Network — Weil, Gotshal & Manges LLP, the international law firm, announced today a significant win on behalf of The
Republic of Ecuador in an investor-state arbitration commenced by the Canadian
oil company EnCana Corporation.

EnCana sought $75 million in VAT refunds denied them by Ecuador. The
tribunal in the arbitration, however, unanimously dismissed all but one of
EnCana’s claims to the refunds on jurisdictional grounds and, with one
dissenting vote, dismissed the remaining claim on the merits. The Weil,
Gotshal & Manges team was led by partners Eric Ordway, Chip Roh and David
Hickerson.

Eric Ordway, who is also co-head of the Global Dispute Resolution group at
the firm, said, “This decision is a significant one for investor-state
arbitrations involving bilateral investment treaties with provisions relating
to tax disputes and could have wider implications in similar cases going
forward.”
