NEW YORK, NY, October 21, 2004 LAWFUEL – Law firm, legal, attorney, law news– Leveraging its leadership in litigation and arbitration, the international law firm Milbank, Tweed, Hadley & McCloy LLP has announced that James N. Benedict and Sean Murphy will join the firm’s New York office as partner and of counsel, respectively.

Prior to joining Milbank, JAMES N. BENEDICT was a litigation partner in the New York office of Clifford Chance LLP. His practice focuses on complex commercial litigation, with an emphasis on multi-party class and derivative suits in state and federal courts throughout the nation. With more than 30 years’ experience, Mr. Benedict has handled a broad range of trial and appellate civil litigation, including securities, antitrust and other issues, for some of the largest corporations in the United States. He has led more than 250 major class and shareholder derivative actions alleging violations of state and federal antitrust and securities laws. Mr. Benedict has also successfully defended numerous excessive management fee suits and other actions mounted against investment companies and their advisors. He frequently lectures and has authored a number of articles on class actions and other litigation matters.

SEAN MURPHY, formerly a partner in the litigation department of Clifford Chance, joins Milbank as of counsel. His practice focuses on complex securities and antitrust matters. Mr. Murphy has defended companies in class action and derivative litigation filed in numerous state and federal courts, often involving regulatory investigations by federal or state agencies. He also has experience in a broad range of antitrust issues, including deal structuring, exchanges of information, trade association membership, and vertical agreements and relationships. He has worked extensively on antitrust investigations by the FTC and the Justice Department, and has obtained regulatory clearance on mergers, acquisitions and joint ventures involving assets of over $1 billion. Murphy has written a number of articles on securities class action litigation.
