OAKLAND – LAWFUEL – The Law Newswire – United States Attorney Scott N. Schools announced that Federal District Judge D. Lowell Jensen sentenced Jermaine Tarver today to 58 months in prison. This sentence is the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Concord Police Department.
Tarver, 32, was indicted by a federal grand jury in November 2006, and charged with being a felon in possession of a firearm in violation of Title 18 United States Code § 922(g)(1).
Mr. Tarver pleaded guilty on April 13, 2007, to being a previously convicted felon in possession of a firearm. According to the plea agreement, Mr. Tarver admitted to possessing a Smith & Wesson .40 caliber handgun which was stolen. The public record indicates that the defendant not only possessed this loaded handgun, but also fired it into the air in an effort to intimidate others.
This prosecution is part of an ongoing effort by the United States Attorney’s Office, under the federal “Project Safe Neighborhood” program, to assist local law enforcement in cracking down on those who possess weapons or ammunition in violation of federal law. United States Attorney Scott N. Schools stated, “This office takes seriously its obligation to ensure that felons who possess firearms and ammunition are prosecuted to the fullest extent of federal law. We will continue to work closely with the Concord Police Department and other local law enforcement agencies to take these dangerous criminals off the streets.”
Michelle Morgan-Kelly is the Assistant U.S. Attorney and Bryan R. Whittaker is the Special Assistant U.S. Attorney who are prosecuting the case with the assistance of Cynthia Daniel and Margaret Glyer. The prosecution is the result of a referral from the Concord Police Department to the Bureau of Alcohol, Tobacco, Firearms and Explosives.
