SAN FRANCISCO –LAWFUEL – Law News US – United States Attorney Kevin V. Ryan announced that Steven Donnelly, a former buyer in UCSF’s Procurement Office, pled guilty to public-corruption charges in connection with allegations that Mr. Donnelly, who was involved in the competitive bidding process for a contract to install fiber obtics to connect all of UCSF’s satellite offices in the San Francisco Bay Area, sold confidential bid information to one of the vendors bidding on the UCSF contract in exchange for $5000.00
According to the plea agreement, Mr. Donnelly, 45, admitted to providing confidential bid information contained on a bid to another company that was competing to be awarded the fiber optics project.
“UCSF was entitled to honest services and a truly competitive bidding process on this important fiber optics project,” USA Ryan said. “According to this plea agreement, an employee of UCSF breached this duty of honest services by undermining the competitive bidding process. My Office is committed to investigating and rooting out corruption.”
Mr. Donnelly is scheduled to be sentenced on April 24, 2007 at 2:00 p.m. before the Honorable William H. Alsup.
The maximum statutory penalty for Theft of Honest Services Mail Fraud in violation of 18 U.S.C. §§ 1341, 1346, and 2 is 20 years and a fine of $250,000. However, any sentence following conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.
Robin Harris is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Ana Guerra. The prosecution is the result of a two month investigation by the Federal Bureau of Investigation.
