SAN FRANCISCO – LAWFUEL- The Law Newswire – United States Attorney Scott N. Schools announced that a federal grand jury in San Francisco yesterday indicted Fawzi Mahmoud Swalim, then a resident of San Francisco, with filing false tax returns from 2000 through 2002. These charges are the result of an investigation by the Internal Revenue Service – Criminal Investigation. The defendant is scheduled to appear at 9:30 a.m. on May 31, 2007, before Magistrate Judge Elizabeth D. Laporte.

According to the indictment, Mr. Swalim, age 53, is alleged to have filed false tax returns from 2000 to 2002, which under-reported gross receipts of his retail grocery business.

The maximum statutory penalty for each count of 26 U.S.C. §7206(1), filing false tax returns, is three years and a fine of $250,000. However, any sentence following conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553. An indictment contains only allegations against an individual and, as with all defendants, Mr. Swalim must be presumed innocent unless and until proven guilty.

David L. Denier is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Kathy Tat. The prosecution is the result of a 18 month investigation by the Internal Revenue Service – Criminal Investigation.
