Cutler as a partner in its Washington, D.C. office and as a member of the law firm’s Government Investigations Department. Cutler leaves his position as the Assistant Director, Division of Enforcement and Investigations, with the Public Company Accounting Oversight Board (PCAOB) in Washington, D.C. to join McGuireWoods.
As the first employee of the newly created PCAOB in 2003, Cutler assisted with the development of the Board’s enforcement program. He investigated and settled the first enforcement action involving the failure of an accounting firm to cooperate with the board’s inspection program. He was lead counsel for more than 30 registration hearings and investigated and settled enforcement cases involving violations of the laws and rules within the PCAOB’s jurisdiction.
Previous to the PCAOB, Cutler was a Senior Counsel at the U.S. Securities & Exchange Commission’s Division of Enforcement in Washington, D.C. He opened the Enron investigation and was instrumental in various settled fraud actions that resulted in more than $320 million of disgorged funds and penalties for distribution to injured Enron investors. He also assisted the SEC and the Department of Justice’s Enron Task Force in related cases, including those against Enron’s former CEO.
