San Francisco Resident Charged with 17 Counts of Filing False Claims with Internal Revenue Service

LAWFUEL – The Legal Newswire – SAN FRANCISCO – United States Attorney Scott N. Schools announced today that a federal grand jury indicted Roger Lexin Mai, of San Francisco, CA on 17 counts of making or presenting false claims to the Internal Revenue Service. These charges are the result of an investigation by the Internal Revenue Service, Criminal Investigation.

According to the indictment, Mr. Mai prepared and presented 17 U.S. Individual Income Tax Returns, Forms 1040 to the Internal Revenue Service, which falsely claimed refunds of $107,049, through electronic filing. Mr. Mai knew these claims were false.

The maximum statutory penalty for each count of false claims in violation of 18 U.S.C. § 287 is five-years imprisonment and a fine of $250,000. However, any sentence following conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.

An indictment contains only allegations against an individual and, as with all defendants, Mr. Mai must be presumed innocent unless and until proven guilty.

Cynthia Stier is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Stefania Chin. The prosecution is the result of a two year investigation by the Internal Revenue Service – Criminal Investigation.
