LawFuel.com – A Florida court of appeals will hear the case as to where Anna Nicole’s body is to be buried, with oral arguments to be presented tomorrow morning.
At 9:30 AM Wednesday, the Fourth District Court of Appeals will hear 20 minutes of arguments from lawyers for Virgie Arthur, Anna Nicole’s estranged mother, who is seeking to bury Anna’s body in Texas, and 10 minutes each from attorneys for Howard K. Stern and Larry Birkhead, both of whom oppose Virgie Arthur’s application and are seeking to have Anna’s remains buried in the Bahamas.
Arthur is seeking an emergency motion to have the higher court overturn the ruling made by Judge Larry Seidlin last Thursday, in which granted custody of Smith’s supposedly decomposing remains to five-month-old Dannielynn via Milstein, her court-appointed guardian ad litem.
On Monday, Seidlin refused to reconsider his decision, but the 4th District Court of Appeal approved Arthur’s request for a stay and gave other parties until 2 p.m. Tuesday to lodge any challenges to the appeal.
Milstein filed an appeal asking the thee-judge panel to uphold the Seidlin decision granting him control over what happened to Anna Nicole.
“This case presents the tragic circumstances of Anna Nicole Smith’s untimely death and the sad irony of her estranged birth mother’s efforts to place her in death where she never wanted to be in life,” Stern’s attorneys wrote.
