Luce Forward Releases California Litigation Guide to Educate Business Owners and General Counsel

Luce, Forward, Hamilton & Scripps LLP, one of California’s leading litigation law firms, today announced the release of The Luce Forward California Litigation Guide, focusing on the unique and sometimes challenging laws companies face when doing business in California. Topics include Unfair Competition, Environmental Law, Employment Law, Procedural Considerations and Insurance Law.

The first edition of The Luce Forward California Litigation Guide, to be distributed nationally, targets business owners, in-house and general counsel, out-of-state attorneys, and C-level executives. Serving as an introduction to highlight key areas of California law, the guide provides a clear explanation on spot issues for those responsible for guiding their company’s legal and business operations in California.

Long considered one of the more litigious states in the country, California’s legal and political environment has given rise to a number of laws and regulations which often surprise out-of-state businesses. One of these laws is the Unfair Competition law – California’s notorious broad statute that allows businesses to be sued by any consumer, competitor or anyone who claims to have been injured by an unfair, unlawful or fraudulent business practice. Additional issues examined in the guide include Proposition 65, wage and hour class actions, achieving summary judgment, and the Genuine Dispute Doctrine.

“Over the last decade, court filings in California have increased by 20 percent and civil cases in excess of $25,000 have grew more than 17 percent; many of these cases are the result of out-of-state businesses unfamiliar with California’s unique legalities,” said Kurt L. Kicklighter, managing partner at Luce Forward. “With the size of California’s population and immense economy, most companies at one time or another will do business here. Our report covers substantial areas of the law that we believe are critical for these businesses to understand.”

Attorneys who contributed to The Luce Forward California Litigation Guide include: co-editors Marc J. Feldman, leader of the Firm’s Insurance Litigation practice group, and business litigation attorney Michael E. Pappas; environmental attorney Cordon T. Baesel; Marie Burke Kenny, leader of the Firm’s Labor & Employment Law practice group; and business litigation attorneys Vicky N. Pham and Jaikaran Singh.
